Leon Panetta, director of the CIA, revealed there was a 25 minute blackout during which the live feed from cameras mounted on the helmets of the US special forces was cut off.

A photograph released by the White House appeared to show President Barack Obama and his aides in the situation room watching the action as it unfolded. In fact they had little knowledge of what was happening in the compound.

Feb. 09, 2011 WASHINGTON — In December 2003, security forces boarded a bus in Macedonia and snatched a German citizen named Khaled el-Masri. For the next five months, el-Masri was a ghost. Only a select group of CIA officers knew he had been whisked to a secret prison for interrogation in Afghanistan.

But he was the wrong guy.

A hard-charging CIA analyst had pushed the agency into one of the biggest diplomatic embarrassments of the U.S. war on terrorism. Yet despite recommendations by an internal review, the analyst was never punished. In fact, she has risen to one of the premier jobs in the CIA’s Counterterrorism Center, helping lead President Barack Obama’s efforts to disrupt al-Qaida.

In the years since the Sept. 11, 2001, terrorist attacks, officers who committed serious mistakes that left people wrongly imprisoned or even dead have received only minor admonishments or no punishment at all, an Associated Press investigation has revealed. The botched el-Masri case is but one example of a CIA accountability process that even some within the agency say is unpredictable and inconsistent.

The United States has not had good intelligence on the whereabouts of Osama bin Laden, the al-Qaeda leader, in years, Leon Panetta, the director of the CIA, admitted on Sunday.

He also gave a sobering account of the war in Afghanistan, saying the Taliban seemed to be strengthening with a stepped-up campaign of violence, even as US-led forces undermine the Islamist movement with attacks on its leadership.

Of greatest concern, he said, was al-Qaeda’s reliance on operatives without previous records or those living in the US.

“We are engaged in the most aggressive operations in the history of the CIA in that part of the world, and the result is that we are disrupting their leadership,” Mr Panetta told ABC television’s “This Week”.

The rare assessment from the US spy chief comes as President Barack Obama builds up US forces in Afghanistan to prop up the government and prevent al-Qaeda from returning. Mr Panetta said only 50 to 100 militants were believed to be operating inside Afghanistan.

Mr Panetta said the al-Qaeda leadership was at its weakest point since the Sept 11, 2001 attacks, but admitted that he had not had reliable intelligence on the location of the group’s leader since “the early 2000s”.

“Since then, it’s been very difficult to get any intelligence on his exact location,” he said. “He is, as is obvious, in very deep hiding … He’s in an area of the tribal areas of Pakistan.”

The pilots waging America’s undeclared drone war in Pakistan could be liable to criminal prosecution for “war crimes,” a prominent law professor told a Congressional panel Wednesday.

Harold Koh, the State Department’s top legal adviser, outlined the administration’s legal case for the robotic attacks last month. Now, some legal experts are taking turns to punch holes in Koh’s argument.

It’s part of an ongoing legal debate about the CIA and U.S. military’s lethal drone operations, which have escalated in recent months – and which have received some technological upgrades. Critics of the program, including the American Civil Liberties Union, have argued that the campaign amounts to a program of targeted killing that may violate the laws of war.

In a hearing Wednesday before the House Committee on Oversight and Government Reform’s national security and foreign affairs panel, several professors of national security law seemed open to that argument. But there are still plenty of caveats, and the risks to U.S. drone operators are at this point theoretical: Unless a judge in, say, Pakistan, wanted to issue a warrant, it doesn’t seem likely. But that’s just one of the possible legal hazards of robotic warfare.

Loyola Law School professor David Glazier, a former Navy surface warfare officer, said the pilots operating the drones from afar could – in theory – be hauled into court in the countries where the attacks occur. That’s because the CIA’s drone pilots aren’t combatants in a legal sense. “It is my opinion, as well as that of most other law-of-war scholars I know, that those who participate in hostilities without the combatant’s privilege do not violate the law of war by doing so, they simply gain no immunity from domestic laws,” he said.

“Under this view CIA drone pilots are liable to prosecution under the law of any jurisdiction where attacks occur for any injuries, deaths or property damage they cause,” Glazier continued. “But under the legal theories adopted by our government in prosecuting Guantánamo detainees, these CIA officers as well as any higher-level government officials who have authorized or directed their attacks are committing war crimes.”

CIA to Spend Millions on Improving ‘Spying Techniques’

The CIA will spend millions of dollars over the next five years to improve intelligence gathering, upgrade technologies and enable analysts to work more closely with spies in the field.

The lack of bilingual agents has been a problem that has plagued military and civilian intelligence officers throughout much of the last decade of war in Afghanistan and Iraq.

US intelligence agencies have come under fire in recent months for perceived lapses that let a suicide bomber infiltrate a CIA base in Afghanistan and an alleged would-be bomber to board a US-bound flight on Christmas.

CIA director Leon Panetta got into hot water with Congress, after he revealed an agency program to hunt down and kill terrorists. A recent report from the U.S. military’s Joint Special Operations University argues that the CIA didn’t go far enough (.pdf). Instead, it suggests the American government should set up something like a “National Manhunting Agency” to go after jihadists, drug dealers, pirates and other enemies of the state.

America’s military, intelligence and law-enforcement agencies already devote thousands of people and billions of dollars to tracking down top terrorists and insurgents. But even the most successful of these efforts – like going after Iraqi militant leader Abu Musab al-Zarqawi – have been “ad hoc” efforts, with units cobbled together from different corners of the government. Report author and retired Lt. Col. George Crawford instead would like to see a permanent group with clear authority, training, doctrine and technology to go after these dangerous individuals. These “manhunting teams would be standing formations, trained to pursue their designated quarry relentlessly for as long as required to accomplish the mission,” he writes.

Sometimes, that will mean operating “in uncooperative countries.” In those cases, the teams must be prepared “to act unilaterally, with no support or coordination with local authorities, in a manner similar to that employed by Israel’s Avner team in response to the Munich Olympics massacre.” (That was the controversial unit, fictionalized in Steven Spielberg’s movie, that allegedly roamed the world, assassinating Palestinian militants in response to the 1972 Olympic attack.)

The hit squads would only be one part of the manhunting agency, according to the Joint Special Operations University monograph, uncovered by Inside Defense. “Dedicated teams must be assembled, able to respond ‘on-call’ in the event of a raid on a suspect site or to conduct independent ‘break-in and search’ operations without leaving evidence of their intrusion,” Crawford notes.

Manhunting will also “require personnel who are experts at conducting surveillance of particular facilities, personnel, or activities without arousing suspicion or being detected,” he adds. “Picture in your mind a typical city street scene, with a little old lady walking her dog, the phone repair crew descending into a manhole, two little old men playing an innocent game of checkers, or the homeless person sleeping on the park bench, and you are on the right track.”
