One of the key figures behind the cascade of documents detailing torture and abuse within America’s global “war on terror” happens to be a Canadian-born graduate of Toronto’s Upper Canada College.

Jameel Jaffer, an American Civil Liberties Union lawyer born in London, Ont., was instrumental in filing and fighting an unlikely Freedom of Information Act request that eventually unearthed thousands of pages of secret documents which illustrated damning evidence of U.S. government complicity in violations of international humanitarian law.

“A lot of the documents describe abuses that are really horrific,” he said in an interview. “It was hard to believe that these incidents had occurred in facilities run by the United States.”

Jaffer told the Star last night that this type of lengthy and expensive legal muck-raking is unlikely to occur in Canada because grants and funding are so scarce. “There are people doing this kind of work in Canada and they have a tough job,” he said.”

The request was filed by Jaffer and fellow ACLU lawyer Amrit Singh – daughter of Indian Prime Minister Manmohan Singh – in October 2003, before the disturbingly iconic Abu Ghraib prison photographs emerged. When those photos came out in April of 2004, they spurred Jaffer and Singh to press their request in court, which is sometimes the only way to successfully pursue an FOI request.

Six years later, more than 130,000 pages of previously classified evidence has trickled out; much of it has been seized upon by critics of America’s seemingly unending global war on terrorism.

The documents uncovered by Jaffer and Singh are a gruesome testament to the grim realities of the post-9/11 world: they revealed fissures between the Federal Bureau of Investigation and the military over how to treat detainees at Guantanamo Bay; vivid descriptions of conditions within the CIA’s overseas “black site” prisons, where detainees were sent without trial; the Justice Department “torture memos,” which revealed prominent U.S. officials had essentially signed-off on torture; and autopsies of prisoners who died in U.S. custody in Iraq and Afghanistan.

The evidence has been seized upon by supporters of the war as well, who say Jaffer and the ACLU have given a propaganda weapon and recruitment beacon for Al Qaeda.

“In general, I think our position is that national security is increasingly used as a pretext to suppress information that would embarrass government officials and information related to criminal activity,” Jaffer told the Star. “And we think that the abuse of national security for those ends is something that, in the end, jeopardizes not just security but democracy as well, and that’s really what motivates a lot of these cases.”

The public’s growing opposition to the conflict comes after the number of British deaths in Afghanistan rose above 200 earlier this month.

Yesterday, Gen Sir David Richards took over as Chief of the General Staff and vowed to get better equipment for troops and improved care for those injured fighting for Britain.

A Daily Telegraph/YouGov poll showed 62 per cent of people opposed British troops staying in Afghanistan, while 26 per cent were in favour.

Previous polls had shown that most people backed the conflict in Afghanistan, unlike the war in Iraq. They accepted the argument espoused by ministers and the opposition that it was part of the fight against terrorism that could be exported to British streets.

If they could vote to keep or replace the entire Congress, just 25% of voters nationwide would keep the current batch of legislators.

A new Rasmussen Reports national telephone survey finds that 57% would vote to replace the entire Congress and start all over again. Eighteen percent (18%) are not sure how they would vote.

Overall, these numbers are little changed since last October. When Congress was passing the unpopular $700-billion bailout plan in the heat of a presidential campaign and a seeming financial industry meltdown, 59% wanted to throw them all out. At that time, just 17% wanted to keep them.

In a new essay in Forbes, Nouriel Roubini writes:

Net public debt is going to double as a share of GDP between 2008 and 2014. Even using the very optimistic forecasts of the Congressional Budget Office, which anticipate growth of around 4% over the next few years, the net debt burden will rise from 40% of GDP to 80%–that’s an increase in the debt stock of about $9 trillion. The interest charge alone on that increased debt will be in the region of $300 billion to $400 billion a year, which in turn may mean more borrowing to pay the interest if primary deficits are not reduced. When governments reach the point where they are borrowing to pay the interest on their borrowing they are coming dangerously close to running a sovereign Ponzi scheme.

Head of China Investment Corporation: China & America are addressing bubbles by creating more bubbles

Lou Jiwei is Chairman and CEO of China Investment Corporation and formerly served as China’s Vice Minister of Finance and as Vice-Governor of Guizhou.

The People’s Republic of China has more than US $2 trillion in currency reserves. The China Investment Corporation was established with the intent of utilizing these reserves for the benefit of the state.

Now Lou Jiwei admits:
“It will not be too bad this year. Both China and America are addressing bubbles by creating more bubbles and we’re just taking advantage of that. So we can’t lose.”

BEIJING (Reuters) – China Investment Corp is investing as much overseas each month this year as it did in all of 2008, Lou Jiwei, the chairman of the $298 billion sovereign wealth fund, said on Saturday.

CIC is counting on handsome returns this year and might one day ask the government to hand it more of the country’s record hoard of foreign reserves to manage, Lou, a former vice finance minister, said.

The fund invested just $4.8 billion outside China last year as it kept its powder dry during the global financial crisis, when asset prices tumbled. It held fully 87.4 percent of its overseas investments in cash or cash equivalents.

Now that markets are recovering, CIC is constructing a broad-based portfolio, Lou told reporters on the sidelines of a forum organized by the Washington-based Brookings Institution and the Chinese Economists 50 Forum, a Beijing think-tank.

CIC posted a negative 2.1 percent return on its global investment portfolio last year as the value of stakes such as those in Wall Street bank Morgan Stanley (MS.N) and private equity giant Blackstone Group (BX.N) slumped.

But Lou said 2009 was shaping up better.

“It will not be too bad this year. Both China and America are addressing bubbles by creating more bubbles and we’re just taking advantage of that. So we can’t lose,” he said.

CIC was set up in September 2007 with $200 billion of foreign currency reserves transferred from the central bank, which manages its own stockpile of $2.13 trillion.

“If our returns are not bad and the state’s FX reserves are still rising, we may go and ask for more,” Lou said.

He said the risk of a decline in the dollar risks was more of a national issue for China than for CIC because its capital is in dollars.

NEW YORK (Reuters) – The U.S. Federal Reserve won a delay of a federal judge’s order that it reveal the names of the banks that have participated in its emergency lending programs and the sums they received.

Chief Judge Loretta Preska of the U.S. District Court in Manhattan stayed her August 24 order in favor of Bloomberg News, which had sought the information under the federal Freedom of Information Act, so that the central bank could appeal.

The Fed’s board of governors has worried that disclosure would stigmatize the participating banks, threatening both them and the U.S. economy.

It argued disclosure threatened “irreparable harm to these institutions and to the board’s ability to effectively manage the current, and any future, financial crisis.”

In April 2009 Andrés Carrasco, an Argentinian embryologist, gave an interview to the leading Buenos Aires newspaper Página 12, in which he described the alarming results of a research project he is leading into the impact of the herbicide glyphosate on the foetuses of amphibians. Dr Carrasco, who works in the Ministry of Science’s Conicet (National Council of Scientific and Technical Investigations), said that their results suggested that the herbicide could cause brain, intestinal and heart defects in the foetuses. Glyphosate is the herbicide used in the cultivation of Monsanto’s genetically modified soya, which now covers some 18 million hectares, about half of Argentina’s arable land. [1]

Carrasco said that the doses of herbicide used in their study were “much lower than the levels used in the fumigations”. Indeed, as some weeds have become resistant to glyphosate, many farmers are greatly increasing the concentration of the herbicide. According to Página 12, this means that, in practice, the herbicide applied in the fields is between 50 and 1,540 times stronger than that used by Carrasco. The results in the study are confirming what peasant and indigenous communities – the people most affected by the spraying – have been denouncing for over a decade. The study also has profound consequences for the USA’s anti-narcotics strategy in Colombia, because the planes spray glyphosate, reinforced with additional chemicals, on the coca fields (and the peasants living among them).

Three days after the interview, the Association of Environmental Lawyers filed a petition with the Argentine Supreme Court, calling for a ban on the use and sale of glyphosate until its impact on health and on the environment had been investigated. Five days later the Ministry of Defence banned the planting of soya in its fields. This sparked a strong reaction from the multinational biotechnology companies and their supporters. Fearful that their most famous product, a symbol of the dominant farming model, would be banned, they mounted an unprecedented attack on Carrasco, ridiculing his research and even issuing personal threats. He was accused of inventing his whole investigation, as his results have not yet been peer-reviewed and published in a prestigious scientific journal.

(Violation of 4th Amendment: Illegal search and seizure)

During either type of declared emergency, a local public health authority… may exercise authority… to require the owner or occupier of premises to permit entry into and investigation of the premises; to close, direct, and compel the evacuation of, or to decontaminate or cause to be
decontaminated any building or facility; to destroy any material; to restrict or prohibit assemblages of persons;

(Violation of 14th Amendment; illegal arrest without a warrant)

…an officer authorized to serve criminal process may arrest without a warrant any person whom the officer has probable cause to believe has violated an order given to effectuate the purposes of this subsection and shall use reasonable diligence to enforce such order. [Gunpoint]

(Government price controls)

The attorney general, in consultation with the office of consumer affairs and business regulation, and upon the declaration by the governor that a supply emergency exists, shall take appropriate action to ensure that no person shall sell a product or service that is at a price that unreasonably exceeds the price charged before the emergency.

“Involuntary Transportation” (also known as kidnapping)

Law enforcement authorities, upon order of the commissioner or his agent or at the request of a local public health authority pursuant to such order, shall assist emergency medical technicians or other appropriate medical personnel in the involuntary transportation of such person to the tuberculosis treatment center.

$1,000 / day in fines

Any person who knowingly violates an order, as to which noncompliance
poses a serious danger to public health as determined by the commissioner or the local public health authority, shall be punished by imprisonment for not more than 30 days or a fine of not more than one thousand dollars per day that the violation continues, or both.

Forced vaccinations

Furthermore, when the commissioner or a local public health authority within its jurisdiction determines that either or both of the following measures are necessary to prevent a serious danger to the public health the commissioner or local public health authority may exercise the following authority: (1) to vaccinate or provide precautionary prophylaxis to individuals as protection against communicable disease…

Forced quarantine for those who refuse (illegal imprisonment without charge)

An individual who is unable or unwilling to submit to vaccination or treatment shall not be required to submit to such procedures but may be isolated or quarantined pursuant to section 96 of chapter 111 if his or her refusal poses a serious danger to public health or results in uncertainty whether he or she has been exposed to or is infected with a disease or condition that poses a serious danger to public health, as determined by the commissioner, or a local public health authority operating within its jurisdiction.

Arrest for refusal to be “decontaminated”

If an individual is unable or unwilling to submit to decontamination or procedures necessary for diagnosis, the decontamination or diagnosis procedures may proceed only pursuant to an order of the superior court… During the time necessary to obtain such court order, such individual may be isolated or quarantined pursuant to section 96 of chapter 111 if his or her refusal to submit to decontamination or diagnosis procedures poses a serious danger to public health or results in uncertainty whether he or she has been exposed to or is infected with a disease or condition that poses a serious danger to public health.

Interrogation

When the commissioner or a local public health authority within its jurisdiction reasonably believes that a person may have been exposed to a disease or condition that poses a threat to the public health, in addition to their authority under section 96 of chapter 111, the commissioner or the local public health authority may detain the person for as long as may be reasonably necessary for the commissioner or the local public health authority, to convey information to the person regarding the disease or condition and to obtain contact information… If a person detained under subsection (1) refuses to provide the information requested, the person may be isolated or quarantined pursuant to section 96 of chapter 111 if his or her refusal poses a serious danger to public health…

Forced isolation and quarantine

An order for isolation or quarantine may include any individual who is unwilling or unable to undergo vaccination, precautionary prophylaxis, medical treatment, decontamination, medical examinations, tests, or specimen collection and whose refusal of one or more of these measures poses a serious danger to public health or results in uncertainty whether he or she has been exposed to or is infected with a disease or condition that poses a serious danger to public health.

Forced entry into any home or building…

There’s a lot more in this bill, including language that allows Mass. police to enter any home or building without a search warrant, to destroy any object or building they suspect may pose a threat to public safety, to order the closing and / or decontamination of any facility using highly toxic chemical decontamination agents, and to arrest, detain and interrogate anyone who gets in their way.

Meanwhile, all state law enforcement and medical personnel are granted complete immunity from prosecution for their part in violating your Constitutional rights. So if they violate your right to due process, or they accidentally destroy your home, or they kill your family dog because they suspect it might be infected, you have absolutely zero recourse.

Under this bill, Massachusetts becomes a medical police state. There is no debating it. It’s all written, clear as day, in this law: The citizens of Massachusetts will have no rights, period. The Constitution is ancient history. You are now the property of the State.

Internet companies and civil liberties groups were alarmed this spring when a U.S. Senate bill proposed handing the White House the power to disconnect private-sector computers from the Internet.

They’re not much happier about a revised version that aides to Sen. Jay Rockefeller, a West Virginia Democrat, have spent months drafting behind closed doors. CNET News has obtained a copy of the 55-page draft of S.773 (excerpt), which still appears to permit the president to seize temporary control of private-sector networks during a so-called cybersecurity emergency.

The new version would allow the president to “declare a cybersecurity emergency” relating to “non-governmental” computer networks and do what’s necessary to respond to the threat. Other sections of the proposal include a federal certification program for “cybersecurity professionals,” and a requirement that certain computer systems and networks in the private sector be managed by people who have been awarded that license.

“I think the redraft, while improved, remains troubling due to its vagueness,” said Larry Clinton, president of the Internet Security Alliance, which counts representatives of Verizon, Verisign, Nortel, and Carnegie Mellon University on its board. “It is unclear what authority Sen. Rockefeller thinks is necessary over the private sector. Unless this is clarified, we cannot properly analyze, let alone support the bill.”

Fed official: Real US unemployment rate at 16 percent

The real US unemployment rate is 16 percent if persons who have dropped out of the labor pool and those working less than they would like are counted, a Federal Reserve official said Wednesday.

“If one considers the people who would like a job but have stopped looking — so-called discouraged workers — and those who are working fewer hours than they want, the unemployment rate would move from the official 9.4 percent to 16 percent, said Atlanta Fed chief Dennis Lockhart.

He underscored that he was expressing his own views, which did “do not necessarily reflect those of my colleagues on the Federal Open Market Committee,” the policy-setting body of the central bank.

Lockhart pointed out in a speech to a chamber of commerce in Chattanooga, Tennessee that those two categories of people are not taken into account in the Labor Department’s monthly report on the unemployment rate. The official July jobless rate was 9.4 percent.

Lockhart, who heads the Atlanta, Georgia, division of the Fed, is the first central bank official to acknowledge the depth of unemployment amid the worst US recession since the Great Depression.

In a declaration filed in the Bloomberg Case (08-CV-9595, Southern District of New York), the banks demonstrate no shame in attempting to perpetuate the status quo with regard to the Federal Reserve and demand that the wool over the eyes of the general population remain firmly planted in perpetuity.

The Clearing House submits this declaration because the Court’s Order threatens to impair the ability of our members to access emergency funds through the New York Fed’s Discount Window without suffering the severe competitive harm that public disclosure of their identity will cause.

Our members have accessed the New York Fed’s Discount Window with the understanding that the Fed will not publicly disclose information about their borrowing, especially their identity. Industry experience, including very recent and searing experience, has shown that negative rumors about a bank’s financial condition – even completely unfounded rumors – have caused competitive harm, including bank runs and failures.

Surely transparency would facilitate rumor-mongering to an unprecedented degree. After all rumors spread much easier when everyone knows the true financial condition of banks.

And here, in plain written Times New Roman, you see what racketeering by a major bank consortium looks like:

If the names of our member banks who borrow emergency funds are publicly disclosed, the likelihood that a borrowing bank’s customers, counterparties and other market participants will draw a negative inference is great. Public speculation that a financial institution is experiencing liquidity shortfalls – which would be a natural inference from having tapped emergency funds – has caused bank customers to withdraw deposits, counterparties to make collateral calls and lenders to accelerate loan repayment or refuse to make new loans. When an institution’s customers flee and its credit dries up the institution may suffer severe capital and liquidity strains leaving it in a weakened competitive position.

Pardon me if I am a broken record here, but would rumors not spread much less if there was more transparency, if investors and other financial intermediaries were fully aware of the conditions of their counterparties, if banks did not have to cover their billions in reserve losses by pretending they are viable and essentially being constant wards of the state?

The Banks’ racketeering has gone on for far too long.

Economy & Stock market: There is no recovery

Green Sharts On The NYSE!:

These four stocks represented thirty seven percent of all shares traded today.

Today 3,162 different stocks traded on the NYSE.  These four represent 0.13% of the total, yet they comprised 37% of the volume.  That’s an over-representation of nearly 300 times the average.

Now folks, let’s be straight here.  Do you believe for one second that this is “great liquidity” added by the “high-frequency trading” computers that are almost certainly behind the vast majority of this volume?

This isn’t the first day with this sort of abnormal trading and volume pattern either.  In fact it has been going on for the last week, with AIG making a frequent appearance on the list as well.

If there was ever an argument to be made for the NYSE having turned into a gigantic “hot potato” parlor game, this is it – in your face in an impossible-to-explain-away fashion.

Stocks led by four wounded horsemen (of  the coming apocalypse):

In fact, these four wounded horsemen of the financial sector comprised 40% of the overall trading volume on the NYSE on Tuesday. These stocks haven’t just been active, they’ve been surging.

This is kind of scary. It suggests that the late-summer portion of the almost six-month long market rally is being fueled more by speculation and momentum, not real optimism about a potential recovery in the financial sector and the overall economy.

The Great Economic Recovery of 2009 Is a Fraud:

If the economy were truly in “recovery” mode, and if consumer demand were truly picking up, the Baltic Dry Index should be moving consistently higher.

It’s not. And that fact should be a major warning sign for anyone buying stocks and betting the economy’s current blip higher is sustainable.

PE Ratio Shows That Today’s Stock Market Is Very Expensive:

From 1936 into the late 1980s, the PE ratio tended to peak in the low 20s (red line) and trough somewhere around seven (green line). The price investors were willing to pay for a dollar of earnings increased during the dot-com boom (late 1990s) and the dot-com bust (early 2000s). As a result of the recent plunge in earnings and recent stock market rally, the PE ratio spiked and just peaked at 144 – a record high. Currently, with 97% of US corporations having reported for Q2 2009, the PE ratio now stands at a lofty 129.

The US banking system will lose some 1,000 institutions over the next two years, said John Kanas, whose private equity firm bought BankUnited of Florida in May.

“We’ve already lost 81 this year,” Kanas told CNBC. “The numbers are climbing every day. Many of these institutions nobody’s ever heard of. They’re smaller companies.” (See the accompanying video for the complete interview.)

Failed banks tend to be smaller and private, which exacerbates the problem for small business borrowers, said Kanas, who became CEO of BankUnited when his firm bought the bank and is the former chairman and CEO of North Fork bank.

“Government money has propped up the very large institutions as a result of the stimulus package,” he said. “There’s really very little lifeline available for the small institutions that are suffering.”

US: Prisoners get spending money to boost economy

Nearly 4,000 US prisoners were sent $250 (£154) economic stimulus cheques by the government to encourage them to go shopping. Officials revealed yesterday that 2,200 convicts were entitled to the money because they had been free when eligibility was determined, although 1,700 prisoners got $425,000 of taxpayers’ money in error.

As a leading Republican in Congress, Eric Cantor, branded the payments “unacceptable”, the US social security administration said many cheques were returned by jails, and that the mistake was a tiny part of Barack Obama’s $787bn stimulus effort.

After all, the 1918 flu virus was dead and buried – until, that is, scientists unearthed a lead coffin to obtain a biopsy of the corpse it contained. Later, researchers similarly disturbed an Inuit woman buried under permafrost.3

The US Armed Forces Institute of Pathology, with a scientist from the Mount Sinai School of Medicine, then began to reconstruct the 1918 Spanish flu. Had Iran or North Korea engaged in Frankenstein experiments (complete with ransacking graves) to reverse engineer the 1918 virus the US and the UK would have gone ballistic at the UN Security Council.

Interestingly, numerous doctors and scientists suspect that the swine flu virus was cultured in a laboratory. A mainstream Australian virologist, Adrian Gibbs – who was one of the first to analyze the genetic properties of the 2009 swine flu – believes that scientists accidentally created the H1N1 virus while producing vaccines. And Dr. John Carlo, Dallas Co. Medical Director, “This strain of swine influenza that’s been cultured in a laboratory is something that’s not been seen anywhere actually in the United States and the world, so this is actually a new strain of influenza that’s been identified.”4 Because of this, the 2009 swine flu virus – which has yet to be detected in any animals – has a rather suspicious pedigree.”

The alarm has been sounded. Politicians, pharmaceutical executives and media conglomerates would have us believe that a 1918-style pandemic is a real threat. The 1918 pandemic, however, evolved out of conditions unique to World War I, for four specific reasons.

Why 2009 Is Not 1918

First, World War I was characterized by millions of troops living in waterlogged trenches along the Western Front. This war zone became fertile ground for an opportunistic virus, as medical literature reveals:

“…a landscape that was contaminated with respiratory irritants such as chlorine and phosgene, and characterized by stress and overcrowding, the partial starvation in civilians, and the opportunity for rapid ‘passage’ of influenza in young soldiers would have provided the opportunity for multiple but small mutational charges throughout the viral genome.”1

Second, the war witnessed the growth of industrial-scale military camps and embarkation ports, such as Etaples in France, enabling the flu virus to enter into another phase of accelerated mutation. On any given day, Etaples was a makeshift city of 100,000 troops from around the British Empire and its former dominions. These soldiers concentrated into unsanitary barracks, tents and mess halls.

THE manufacturer of the Taser stun gun is sparking new controversy with the commercial launch of a long-range version that can be fired from a 12-bore shotgun.

Government-funded tests on initial versions of the new Extended Range Electronic Projectile (XREP) have revealed possible health risks to people on the receiving end, New Scientist has learned. The manufacturer, Taser International of Scottsdale, Arizona, says the issue has been addressed in redesigned devices, but these have yet to be independently tested.

Unlike the current Taser X26, which fires darts attached to short wires, the XREP is wire-free. Its projectile, the size of a shotgun cartridge, is designed to pierce the target’s skin and contains battery-powered circuits that deliver a debilitating shock. It has a range of 20 metres or more, compared with 5 metres for previous Tasers.

A team led by Cynthia Bir, a trauma injury specialist at Wayne State University in Detroit, Michigan, found that some of the 275 XREP cartridges that Taser supplied for testing last year were capable of delivering an electric shock for more than 5 minutes, rather than the 20 seconds of shocking current they are supposed to generate. Previous Taser stun guns shock for only 5 seconds per discharge, though that can be repeated.

Italian bank vaults may soon resemble well stocked delicatessens if a plan goes ahead to accept expensive wines and dry-cured hams as collateral on bank loans from crisis-hit producers.

The idea, which was launched this week by an influential Italian bank chairman and wine producer, was backed by an Italian minister and follows the tradition of Italian banks storing massive wheels of parmesan cheese as loan collateral.

“We’ve done it with cheese, why not with prosciutto and good wines like Brunello di Montalcino and chianti classico?” said Gianni Zonin, chairman of the Banca Popolare di Vicenza and head of wine producer Zonin.

“This is a great idea, it has my blessing,” said Luca Zaia, the Italian agriculture minister.

The Italian bank Credito Emiliano has long stored hundreds of thousands of parmesan wheels, worth about ¤300 each, in warehouses as collateral while they age.

ACLU sues the Department of Homeland Security over laptop searches

The American Civil Liberties Union on Wednesday sued the Department of Homeland Security in an effort to uncover documents related to laptop searches at the border.

“The ACLU believes that suspicionless searches of laptops violate the First and Fourth Amendments,” the group wrote in the suit, filed in a New York District Court.

In July 2008, the Customs and Border Protection agency within DHS published formal guidelines for laptop border searches that gave CBP officials permission to search laptops and electronic devices at the border. Court cases on the topic have generally found that citizens should have diminished expectations of privacy when re-entering the country because the U.S. has a right to protect itself and control what crosses its borders.

Critics of the policy claim that laptop searches are an invasion of privacy – a personal computer holds a lot more information than a suitcase full of clothes or briefcase full of paperwork. What’s to stop CBP from copying the contents of your computer and keeping it on file indefinitely, they have argued

As a result, the ACLU wants to know exactly what types of data the government has collected. The organization first filed a Freedom of Information request in June 2009, but after some back and forth between the ACLU and DHS, the ACLU said that it had “exhausted the applicable administrative remedies” and that “DHS and its components have wrongfully withheld the requested records from the ACLU.”

Wegelin bank to pull out of US

Swiss private bank Wegelin announced on Tuesday that it is to stop doing business in the United States.

The St Gallen-based bank, Switzerland’s oldest, said the decision had been taken in response to stricter measures introduced in the US against tax dodgers and planned changes to estate tax, which would make some non-US citizens liable to tax if they inherited US securities.

In a letter to investors it said Swiss banks were likely to find themselves in an untenable position, as they would be expected to know which clients were liable to pay US tax – “an impossible undertaking”, given the lack of clear definitions in the matter.

The danger of inadvertently making false declarations to the US tax authorities will be too great, it explained.

It added that it believes the US overestimates its attraction as a financial centre, and is advising its clients to get out of all US securities.

Aug. 21 (Bloomberg) — Meredith Whitney, the analyst who predicted that Citigroup Inc. would cut its dividend last year, said the number of U.S. bank failures will quadruple as lenders struggle with bad loans.

“There will be over 300 bank closures,” Whitney said in an interview with Bloomberg Television from Jackson Hole, Wyoming. “The small-business owner on Main Street continues to see liquidity come away.”
